Vina (latinsky culpa, německy Schuld, anglicky guilt) je stav, kdy se pachatel dopoustil trestného činu a má za to nést následky.

Angloamerické a německé právo klade na vinu hlavní důraz. Porota vynáší verdikt vinen / nevinen (guilty / not guilty). Výjimkou je Skotsko, kde přežívá i výrok not proven. V českém postkommunistickém právu není vina tak důležitá a hlavní důraz je kladen na trest. Výjimkou dlouho byla Marta Chadimová, ale i ta nakonec milost přijala.[1]

Our collective conscience does not allow punishment where it cannot impose blame. Dalším důkazem odcizení konceptu vinu v českém postkommunistickém prostředí je všeobecné nepochopení principu presumpce neviny.
